SpookyBox - Halloween Companion
Please read these Terms of Service ("Terms") carefully before using the SpookyBox mobile application (the "App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Ibrahim Oktay ("we," "us," or "our").
The App is intended for users aged 13 years or older. By using the App, you represent and warrant that you are at least 13 years of age. If you are under 18 years of age, you must have your parent or legal guardian's permission to use the App.
If you are a parent or legal guardian and you provide consent for your child to use the App, you agree to be bound by these Terms on behalf of your child and you are responsible for your child's use of the App.
We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13 years of age. If we discover that we have collected personal information from a child under 13, we will delete that information immediately.

All purchases and subscriptions are processed through Apple's App Store. By purchasing a subscription, you agree to:
Your subscription will automatically renew at the end of each subscription period unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time through your Apple ID account settings.
You may cancel your subscription at any time. Cancellation will be effective at the end of your current billing period. Refunds are handled in accordance with Apple's App Store refund policies. We do not provide refunds for partial subscription periods.
We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewals. You will be notified of any price changes in advance.

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, audio, video, design, and the selection and arrangement thereof) are owned by Ibrahim Oktay, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the App for your personal, non-commercial use. This license does not include any right to:

Our total liability to you for all claims arising out of or relating to these Terms or the App shall not exceed the amount you paid to us in the twelve (12) months prior to the claim, or $100 USD, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

In the event of any dispute arising out of or relating to these Terms or the App, the parties agree to first attempt to resolve the dispute through good-faith negotiations.
You agree that any legal action or proceeding between you and us shall be brought exclusively in a court of competent jurisdiction located in your jurisdiction of residence, and you consent to the personal jurisdiction of such courts.
If you access the App from outside the country where we are based, you are responsible for compliance with local laws and regulations.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
